TTHE DOOTY PATROL LLC — Terms of Service
1. Introduction
These Terms of Service (“Terms”) govern the relationship between TTHE DOOTY PATROL LLC (“Company,” “we,” “our,” or “us”), a Massachusetts limited liability company, and its customers (“Customer,” “you,” or “your”). By using our services, you agree to these Terms.
2. Definitions
Services: Pet waste removal and related services provided by the Company.
Customer Property: The yard, lawn, or premises where Services are performed.
TTHE DOOTY PATROL Account: Customer’s online portal for scheduling, billing, and service management.
3. Services Provided
a. Service Frequencies: weekly, twice per week, or other options offered.
b. Service is not provided on weekends or major holidays.
c. Service may be rescheduled due to severe weather, with credits applied.
d. Free initial cleanup is available only with enrollment in recurring service.
e. Proof of Service; Notifications. The Company may send ETA notifications and completion confirmations (including photographs of serviced areas) via text or email. By accepting these Terms, the Customer consents to such notifications and limited capture/retention of property photographs for proof and quality control.
4. Customer Responsibilities
a. Provide safe access (unlocked gates, safe yard conditions).
b. Ensure dogs are secured during service.
c. Maintain yards reasonably accessible (not overgrown, obstructed, or hazardous).
5. Payment Terms
a. Billing occurs on the 1st of each month; mid-month sign-ups are prorated.
b. Prepayment is required; VISA or MasterCard must be kept on file.
c. If payment fails, service is paused until payment clears.
d. Customers may cancel anytime; if billing has run and service has been delivered, only the unused portion will be refunded.
e. Promotional Clawback. Promotional offers (including any free initial cleanup) are offered solely with recurring enrollment. If canceled immediately after redemption, the Company may retroactively charge the standard fee or recover the value of the promotion.
6. Scheduling & Cancellations
a. Customers may pause, cancel, or reschedule anytime via their PUPZIE Account.
b. If canceled at least 24 hours in advance, the Customer may choose a refund or credit.
c. Missed visits or access issues (locked gate, unsecured dogs) are billed as completed; Company may attempt to reschedule.
d. Service Windows & Routing. The Company schedules Services within route windows and does not guarantee exact arrival times. Routing, traffic, and weather may affect timing.
7. Refunds & Credits
a. Refunds/credits issued at Company discretion unless otherwise specified.
b. If canceled mid-cycle, unused portion refunded.
c. Satisfaction Re-clean Policy. If Customer notifies Company within 48 hours of unsatisfactory service, Company will, at its election, schedule a re-clean within three (3) business days where practicable, or issue a credit/refund.
8. Access & Missed Visits
Access issues are billed; ongoing issues continue until Customer terminates service.
9. Health & Safety
a. Company may reschedule during unsafe weather.
b. Customers must secure aggressive animals.
c. Service Limitations. The Company does not guarantee removal of every instance of waste if conditions impair visibility (e.g., tall grass, debris, snow, ice).
10. Liability & Indemnification
a. Limitation of Liability. Company is not liable for direct, indirect, incidental, consequential, or punitive damages arising from Services.
b. Cap on Liability. Company’s liability shall not exceed one (1) month of fees paid immediately preceding the event.
c. Indemnification. Customer agrees to indemnify and hold harmless Company from claims arising from: (i) Customer’s use of Services; (ii) breach of Terms; (iii) yard conditions; or (iv) Customer’s negligence or misconduct.
11. Service Termination
a. Customer may terminate anytime through their PUPZIE Account. Refunds apply only to unused service.
b. Company may terminate for any reason, including non-payment, unsafe yard conditions, or harassment.
c. Outstanding balances remain due regardless of termination.
12. Privacy & Data
a. Company collects and uses personal/payment info solely for business purposes.
b. Photographs. Proof-of-service photos may be taken and retained for up to 90 days for quality control or disputes. See Privacy Policy for details.
13. Governing Law & Arbitration
a. These Terms are governed by Massachusetts law.
b. Disputes should be resolved informally where possible.
c. Either party may elect arbitration in Massachusetts under AAA rules.
d. Either party may alternatively bring action in Massachusetts courts; both consent to jurisdiction.
14. Amendments
Company may amend these Terms at any time by posting the revised version on its website. Changes take effect immediately upon posting. Continued use of Services constitutes acceptance.
